CONCLUSION OF THE PURCHASE CONTRACT
The conclusion of the purchase contract is only available in German and English language.
The presentation of products in our online shop is not a legally binding offer but a non-binding online catalogue. You may select desired items of the products presented in our online shop by clicking the button “IN YOUR SHOPPING BAG” and add these items to the so called “shopping bag”. In our overview pages displaying several products you may have the option to use our “Quick Shop”-tool. When hovering your computer mouse over the displayed product image the “Quick Shop”-button appears. Clicking this button will open a separate window providing you with the possibility to add the item to you shopping bag directly by an additional click on the “shopping bag symbol”.
You may find the “shopping bag”-button above the navigation bar. It is represented by an icon shaped as a shopping bag. The current content of your shopping bag will be displayed when hovering over this button. Furthermore, the buttons “SHOPPING BAG” and “CHECKOUT” will appear. By clicking the button “SHOOPING BAG” you can access your shopping bag and make changes to your order at any time, in particular, you will be able to remove selected items from the shopping bag. When clicking the button “CHECKOUT” you will have the option to log in to your customer account or to continue as guest, or to log in to your payment service provider account such as “amazon pay” or “PayPal”. You will then access the order summary. You may add your personal information and choose between the available payment methods and shipping options. You are free to modify and correct the details of your order, or to cancel the purchase until you click the button „CHECKOUT“.
Please note, when using the services of a payment service provider such as „PayPal“ you may be directed to the website of your payment service provider first before accessing our order summary page. If you are directed to your payment service provider’s website please enter the details required by your payment service provider. Afterwards you will be redirected to our online shop’s order summary page. You are free to modify and correct the details of your order, or to cancel the purchase until you click the button „CHECKOUT“. By clicking the button “CHECKOUT” you submit a legally binding offer to conclude a purchase agreement. We will send you a receipt of your order via email immediately after your submission including the details of your order. This receipt of your order does not constitute an acceptance of your offer. We may accept your offer via an email confirmation of order or by delivery of the goods within five days after your submission.
You can cancel your order yourself within 30 minutes in your customer account under ‘Orders’. After 30 minutes, the order will be sent to us and prepared for dispatch.
The text of these general terms and conditions will not be saved after concluding the purchase contract. You may access the current version of our general terms and conditions through our online shop. Additionally, you have the possibility to access and print out or save electronically our general terms and conditions via your internet browser before submitting your order.
STATUTORY DEFECT WARRANTY
We are liable for material defects and legal defects of the goods in line with the applicable statutory provisions, including Sections 434 of the German Civil Code (BGB). With respect to B2B customers (entrepreneurs) the seller’s defect warranty period for goods ends 12 months after delivery of the goods.

Participation requires a valid email address, which will serve as the username for your Niche Beauty customer account.
Your Niche Beauty customer account is non-transferable and may only be used for your personal and private purposes. The Program is intended solely for your own purchases.
1.3. Formation of Contract
A contract for the use of the Program is concluded once we accept your request to join (e.g., by confirming it on our website).

1.5. Collecting Points
As a member of the Program, you can earn points through purchases in the Niche Beauty online shop. Additional bonus points may be earned through special promotions.
Each point collected is equivalent to one Status Point.
To receive points, you must be logged into your Niche Beauty customer account at the time of purchase. If you sign up for THE CLUB after placing an order, you can still receive points for that most recent order by registering via the link on the order confirmation page.
If an order is cancelled or reversed (e.g., due to cancellation, return, or contract withdrawal), or in cases of abuse (e.g., account sharing to earn points on others' purchases), Niche Beauty reserves the right to reverse any corresponding point credits.
1.6. Points Balance
Your collected points are credited to an account maintained by us. You can view your current balance at any time in the THE CLUB section of the website or app.
We may also inform you of your points balance via email or postal mail.
Objections to the accuracy or completeness of your points statement must be made within one month in writing or in text form (e.g., by email). Failure to do so is deemed acceptance. After that, you may still request a correction, but you must provide proof of the inaccuracy.
1.7. Purchase of Points
You cannot purchase points or any products that can be converted into points.
1.8. Redeeming Points
You can redeem your collected points for rewards at Niche-Beauty.COM, provided your account holds a sufficient points balance.
Redemption is subject to the availability of the chosen rewards. Available rewards and their required points will be announced on our website or through specific promotional terms.
Cash payment in exchange for reward points is not possible.
Status Points are not redeemable.
1.9. Validity of Status Levels and Status Points
Essential & Exclusive:
Status Points are valid for 12 months from the date they are credited. After 12 months, your points balance is reviewed, and your status level may be downgraded.
VIP:
Status Points are valid for 24 months from the date of credit. After this period, a review is conducted, and status level adjustments may be made.
If you reach a higher status level during this period, you will automatically be upgraded. Once upgraded, your new status level remains valid for 12 months.
You will be notified by email when you reach a new status level.
1.10. Expiration of Points
Collected but unused points expire after 12 months. Expired points cannot be redeemed.
1.11. Termination of Contract
Both you and we may terminate the agreement regarding your participation in the Program at any time.
If you terminate the agreement, the notice period is one month. If we terminate it, we will provide at least three months’ notice. The right to terminate without notice for just cause remains unaffected.
After termination, you will no longer be able to collect new points.
Your membership is personal and cannot be transferred or inherited. Upon the member's death, the contract ends automatically, and any remaining points are forfeited.
1.12. Misuse of the Program
If there are documented indications of misuse of your customer account, we may temporarily suspend your account.
If grounds exist for extraordinary termination, we may instead choose to temporarily suspend your account.
1.13. Changes to the Program and Terms

1.15. Change of Contact Information
You must inform us promptly of any changes to your name or contact details.
Name changes must be submitted in writing. Address changes may be made directly in your customer account, or by phone or email.

1.17. Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

To meet the deadline, it is sufficient to send the withdrawal notice before the 14-day period ends.
Consequences of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs from selecting a different delivery method), without delay and no later than 14 days from the day we receive your withdrawal.
We will use the same payment method as the original transaction unless otherwise agreed, and you will not be charged any fees for the refund.

1.18. Limitation of Liability
Niche Beauty is liable for intent and gross negligence, as well as for injury to life, body, or health in accordance with statutory provisions.
In all other cases, we are liable for simple negligence only in the event of a breach of essential contractual obligations (“Cardinal Duties”). Liability is limited to foreseeable damages typical of the contract.
Any further liability is excluded. This limitation also applies to our employees, representatives, legal agents, and vicarious agents.
Liability under product liability laws or for expressly granted guarantees remains unaffected.

Enjoy exclusive benefits as a club member: Save up to 3 Superbrands and enjoy 15% off every order from these brands - up to a defined limit. Right of Cancellation
INFORMATION CONCERING THE RIGHT OF CANCELLATION
According to section 13 of the German Civil Code (BGB) a consumer is any natural person who enters into a legal transaction for purposes that can largely be counted as neither a commercial nor an independent professional activity.
Right of Cancellation
The cancellation period is fourteen days from the date when you or a third party designated by you who is not the carrier has taken possession of the goods.

You can also fill out and submit the template cancellation form or another clear statement electronically on our website [https://niche-beauty.com/en-de/info/cancellation-form] If you choose to exercise this option we will immediately acknowledge receipt for your cancellation (e.g. by email). You will have complied with the time limit for giving notice of cancellation if it is sent before the end of the cancellation period.
Consequences of cancellation
If you cancel this contract, we immediately have to refund all payments received from you, including delivery costs (with the exception of any additional costs incurred due to your having chosen a different type of delivery than the cost-effective standard delivery that we offer). This must be done within no more than fourteen days from the date when we receive your notice of cancellation. For this refund we will use the same payment method as the one that you used to carry out the original transaction unless we have explicitly made a different agreement with you; on no account will this refund cost you anything.
We may refuse to make a refund until the goods have been returned to us or until you have proved that you have returned the goods, whichever is earlier.
You must send or hand over the goods to us immediately and in any case no later than within fourteen days of informing us that you intend to cancel this contract. You will have complied with the time limit if you send the goods before the fourteen-day period has expired.
You only have to reimburse us for any loss in the value of the goods if this loss of value has been caused by handling the goods in a way that is not necessary in order to inspect their condition, characteristics, and functionality.
Please note: a 100 percent refund of your return can only be made if the items arrive in their original packaging and unused. For used items we reserve the right to withhold a part of the refund amount. Please also note that we can only take back hygiene articles (vibrators and cone trainers) which still have the existing seal and which are not defective. The return of vouchers and e-vouchers is also excluded.
Exclusion of the right of cancellation
In the following cases, you do not have a right of cancellation for contracts:
for the supply of goods that are not prefabricated and which are produced in accordance with the consumer's individual choices or specifications or that are obviously tailored to the consumer's personal requirements,
for the supply of goods that may rapidly spoil or whose use-by date would soon be passed,
for the supply of sealed goods which are unsuitable for return for reasons of health or hygiene if their seal has been removed after delivery,
for the supply of goods that, due to their condition, have been inseparably combined with other goods after delivery, for the supply of perfume samples
