General Terms and Conditions

SCOPE OF APPLICATION

All orders placed through our online shop shall be governed by the following General Terms and Conditions.

CONTRACTING PARTIES, CUSTOMER SERVICE

The contract of sale is between you and NICHE-BEAUTY.COM GmbH. Further information about us can be found in the Legal Notice. In the event of any questions, complaints, or objections you can contract Customer Service under the telephone number +49 (0)40 8662756 - 0.

CONCLUSION OF THE PURCHASE CONTRACT

The conclusion of the purchase contract is only available in German and English language.

The presentation of products in our online shop is not a legally binding offer but a non-binding online catalogue. You may select desired items of the products presented in our online shop by clicking the button “IN YOUR SHOPPING BAG” and add these items to the so called “shopping bag”. In our overview pages displaying several products you may have the option to use our “Quick Shop”-tool. When hovering your computer mouse over the displayed product image the “Quick Shop”-button appears. Clicking this button will open a separate window providing you with the possibility to add the item to you shopping bag directly by an additional click on the “shopping bag symbol”.

You may find the “shopping bag”-button above the navigation bar. It is represented by an icon shaped as a shopping bag. The current content of your shopping bag will be displayed when hovering over this button. Furthermore, the buttons “SHOPPING BAG” and “CHECKOUT” will appear. By clicking the button “SHOOPING BAG” you can access your shopping bag and make changes to your order at any time, in particular, you will be able to remove selected items from the shopping bag. When clicking the button “CHECKOUT” you will have the option to log in to your customer account or to continue as guest, or to log in to your payment service provider account such as “amazon pay” or “PayPal”. You will then access the order summary. You may add your personal information and choose between the available payment methods and shipping options. You are free to modify and correct the details of your order, or to cancel the purchase until you click the button „CHECKOUT“.

Please note, when using the services of a payment service provider such as „amazon pay“ or „PayPal“ you may be directed to the website of your payment service provider first before accessing our order summary page. If you are directed to your payment service provider’s website please enter the details required by your payment service provider. Afterwards you will be redirected to our online shop’s order summary page. You are free to modify and correct the details of your order, or to cancel the purchase until you click the button „CHECKOUT“. By clicking the button “CHECKOUT” you submit a legally binding offer to conclude a purchase agreement. We will send you a receipt of your order via email immediately after your submission including the details of your order. This receipt of your order does not constitute an acceptance of your offer. We may accept your offer via an email confirmation of order or by delivery of the goods within five days after your submission.

The text of these general terms and conditions will not be saved after concluding the purchase contract. You may access the current version of our general terms and conditions through our online shop. Additionally, you have the possibility to access and print out or save electronically our general terms and conditions via your internet browser before submitting your order.”

STATUTORY DEFECT WARRANTY

We are liable for material defects and legal defects of the goods in line with the applicable statutory provisions, including Sections 434 of the German Civil Code (BGB). With respect to B2B customers (entrepreneurs) the seller’s defect warranty period for goods ends 12 months after delivery of the goods.

SHIPPING COSTS

Shipping costs will be added to the prices quoted for the products.

For deliveries within Germany and to Austria we charge a flat rate of € 3.95 per order. We offer free shipping for orders of € 25.00 or more.
For deliveries to Switzerland e charge a flat rate of € 3.95 per order. We offer free shipping for orders of € 50.00 or more.
For deliveries to other EU countries we charge a flat rate of € 15.00 (€ 25.00 for the Balearic/Canary Islands).
Additional customs duties, taxes, and charges are usually incurred for deliveries to non-EU countries.

DELIVERY TIME

We deliver orders within Germany and to Austria within 1 to 3 working days. Deliveries to Switzerland, Liechtenstein and the rest of EU will be delivered within 2 to 7 working days.

PAYMENT OPTIONS

Paypal, Debit, Credit Card, invoice, instant transfer (Sofortüberweisung), cash on delivery (C.O.D.)or advance payment.

PayPal

After clicking on Purchase Now, you will be redirected to the PayPal site where you're asked to pay. As soon as you've completed this step, your order has been created.

Debit

Your debit card account will be debited on completion of the order. This service is operated by PayPal. You don't have to have a PayPal account.

Credit card

Your credit card account will be debited on completion of the order.This service is operated by PayPal. You don't have to have a PayPal account.

Invoice

Sofortüberweisung (instant transfer)

We also offer instant transfer. This means that the amount in question is directly credited to our account. This speeds up the entire order process. All you need is an account number, a bank code, a PIN, and a TAN. Sofortüberweisung automatically places a transfer instruction in your online bank account in real time through the secured payment form of Sofort AG, which is not accessible to retailers. The purchase amount is then immediately transferred to the bank account of NICHE-BEAUTY.COM GmbH. This service is completely free for you as a customer. The only fees you may incur are those charged by your house bank (transfer fee).
If you choose instant transfer as the payment method a completed form will open up at the end of the order process. This already contains our bank account details. In addition, the form already shows the amount to be transferred and the purpose. All you have to do now is select the country where you have your online banking account and enter the bank code. Then you enter the same data as the data you enter when logging in for online banking (your account number and PIN). Confirm your order by entering the TAN. The transaction will then be confirmed straight away.
In principle all Internet users can use instant transfer as a payment method if they have an activated online banking account that uses the PIN/TAN procedure. Please note that a few banks still do not offer instant transfer. Payment in advance

If you select "Payment in Advance" as the payment method we will give you our bank account details in the order confirmation and deliver the goods on receipt of payment.

Cash on delivery (C.O.D.)

If you select cash on delivery (C.O.D.) as the payment method there will be an extra charge of EUR 5.00.

COLLECTION BY THE CUSTOMER

We deliver only through shipment. Unfortunately it is not possible for you to collect the goods yourself.

During the Glamour Beauty Week from 2 - 9.6.2018 you have the possibility to get 15 % discount on the whole assortment. You will find the code for this in the current issue of Glamour magazine. Some brandss may be excluded from the promotion.

The combination possibilities differ between various promotion codes. Unless otherwise specified, promotions are valid while stocks last. Perfume samples do not count as orders that include free items. Errors and omissions excepted. If the order is returned in full or in part, free items must be returned in full.

Right of Cancellation

INFORMATION CONCERING THE RIGHT OF CANCELLATION

According to section 13 of the German Civil Code (BGB) a consumer is any natural person who enters into a legal transaction for purposes that can largely be counted as neither a commercial nor an independent professional activity.

Right of Cancellation

The cancellation period is fourteen days from the date when you or a third party designated by you who is not the carrier has taken possession of the goods.

You can also fill out and submit the template cancellation form or another clear statement electronically on our website [https://niche-beauty.com/en-de/info/cancellation-form] If you choose to exercise this option we will immediately acknowledge receipt for your cancellation (e.g. by email). You will have complied with the time limit for giving notice of cancellation if it is sent before the end of the cancellation period.

Consequences of cancellation

If you cancel this contract, we immediately have to refund all payments received from you, including delivery costs (with the exception of any additional costs incurred due to your having chosen a different type of delivery than the cost-effective standard delivery that we offer). This must be done within no more than fourteen days from the date when we receive your notice of cancellation. For this refund we will use the same payment method as the one that you used to carry out the original transaction unless we have explicitly made a different agreement with you; on no account will this refund cost you anything.

We may refuse to make a refund until the goods have been returned to us or until you have proved that you have returned the goods, whichever is earlier.

You must send or hand over the goods to us immediately and in any case no later than within fourteen days of informing us that you intend to cancel this contract. You will have complied with the time limit if you send the goods before the fourteen-day period has expired.

You only have to reimburse us for any loss in the value of the goods if this loss of value has been caused by handling the goods in a way that is not necessary in order to inspect their condition, characteristics, and functionality.

Exclusion of the right of cancellation

In the following cases, you do not have a right of cancellation for contracts:

for the supply of goods that are not prefabricated and which are produced in accordance with the consumer's individual choices or specifications or that are obviously tailored to the consumer's personal requirements,
for the supply of goods that may rapidly spoil or whose use-by date would soon be passed,
for the supply of sealed goods which are unsuitable for return for reasons of health or hygiene if their seal has been removed after delivery,
for the supply of goods that, due to their condition, have been inseparably combined with other goods after delivery, for the supply of perfume samples
